ARTICLE 3 – SCOPE AND APPLICABILITY

These Terms apply to all offers made by Eden & East and to all distance contracts and orders concluded between the company and the consumer.

Before a contract is concluded, these Terms will be made available to the consumer. Where this is not reasonably possible, the consumer will be informed how to access them and may request a free copy.

Where contracts are concluded electronically, these Terms will be made available in a format that allows storage on a durable medium.

If specific product or service conditions apply in addition to these Terms, both shall apply. In case of conflict, the provision most favourable to the consumer shall prevail.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force. The invalid provision shall be replaced by a valid one that most closely reflects the original intent.

All offers are non-binding. Eden & East reserves the right to amend or withdraw offers at any time.

Product descriptions are provided with reasonable accuracy to allow proper assessment. Images are for illustrative purposes and reflect products as accurately as possible. Obvious errors or mistakes do not bind the company.

All product images, specifications, and descriptions are indicative and cannot form the basis for compensation or contract termination. Minor colour differences may occur due to lighting or screen settings.

- Canda: orders shipped to Canada are delivered DDP (Delivered Duty Paid). VAT and import duties (where applicable) are included in the displayed price. No additional customs charges are payable on delivery.
- Other countries: prices exclude import VAT, customs clearance costs, and duties. These charges, where applicable, are the responsibility of the customer and may be collected by the carrier upon delivery.

ARTICLE 5 – DELIVERY ISSUES

If a shipment is returned due to:

an incorrect or incomplete address provided by the customer,
failure to collect the parcel, or
refusal of delivery,

Eden & East reserves the right to deduct actual return shipping costs and any carrier-imposed fees from the refund amount.

This applies only where the failed delivery is attributable to the customer.

No deductions will apply where delivery failure results from an error by Eden & East, the carrier, or circumstances beyond the customer’s control.
